Exclusion of the Right of Withdrawal for Dietary Supplements

According to Swiss law (Article 40a of the Code of Obligations), there is no right of withdrawal for sealed goods that, for reasons of health protection or hygiene, are not suitable for return. Since Tyrexin™ is a dietary supplement intended for consumption, we cannot accept any returns or exchanges of products for health and hygiene reasons, whether opened or unopened. This regulation serves exclusively your safety and the safety of all our customers.

Why No Right of Withdrawal? Your Health is at the Center

Dietary supplements are highly sensitive products that you ingest. Unlike clothing, electronics, or other consumer goods, these are substances that you consume and that can have a direct influence on your health. This is precisely why special regulations apply to this product category to protect you as a consumer.

Imagine: a customer orders Tyrexin™, takes a few capsules, and then returns the product. We cannot possibly determine with certainty under what conditions this product was stored in the meantime. Was it in an overheated car? Was it kept in a humid environment? Was the seal opened and resealed? Were individual capsules removed and replaced with other substances? All these scenarios may seem unlikely, but they cannot be ruled out.

The acceptance and reuse of dietary supplements would mean that we might send you a product that has already been in another customer's hands. Would you want to consume such a product? We are convinced that the answer is clear: no. You rightfully expect that every package you receive is fresh, unopened, and stored under optimal conditions. This is exactly what we can only guarantee if we do not accept returns.

The Invisible Risks: What Can Happen After Shipping

Once a dietary supplement leaves our controlled warehouse, we can no longer monitor the storage conditions. During delivery, the package may be exposed to extreme temperatures, in summer in a hot delivery truck or in winter in freezing cold. After delivery, it may sit in a warm entrance hall for days before being picked up.

These factors alone are already part of the normal shipping process and are taken into account by us. Our products are formulated and packaged to withstand these normal shipping conditions. What we cannot control, however, is the subsequent storage at the customer's location. The product may be stored next to strongly scented substances, kept in humid rooms, or exposed to direct sunlight.

In case of a return, the product would again be exposed to all transport risks, this time without our control over packaging and shipping conditions. It could be returned in a regular letter or parcel box, without the special protective packaging we use. The capsules could be damaged during return transport, moisture could penetrate, or the product could again be exposed to extreme temperatures.

Even if the returned product appears intact externally, we cannot rule out that the active ingredients have been impaired by improper storage or transport. A complete quality check of each returned package would not be technically feasible and would nevertheless not be able to guarantee product safety.

Protecting All Customers: A Responsible Approach

If we were to accept returns, we would have to either destroy these products, which would be uneconomical and environmentally harmful, or put them back into circulation. The destruction of returned products would mean that we would ultimately have to pass these costs on to all customers, which would lead to higher prices for everyone. The alternative, reselling returned products, is not an option for us because we could no longer guarantee product safety.

Consider: would you want to consume a dietary supplement where there is even the slightest possibility that it has already been with another customer? Even if the seal appears intact, modern sealing techniques could make it possible to open and reseal packages without this being obviously visible. This thought may be unpleasant, but it illustrates why the exclusion of the right of withdrawal is actually in your own interest.

Imagine someone had an allergic reaction to a product and returned it. Even if the person did not open the package, traces of allergens could have gotten onto the packaging from the outside. If we were to resend this package, this could pose a risk for the next customer who is also allergic. Such scenarios may be rare, but they are not impossible, and we do not want to take any risk when it comes to your health.

Legal Basis: The Legislator Protects You

The Swiss Code of Obligations expressly provides in Article 40a that for sealed goods that, for reasons of health protection, are not suitable for return, there is no right of withdrawal. This legal regulation is not a coincidence nor an invention of individual companies. It is based on the recognition that certain product categories impose special requirements on hygiene and safety.

The legislator has recognized that for dietary supplements, medicines, and similar products, the health of consumers must take precedence over general consumer protection law. The right of return, which is obvious for most products, would create a health risk for consumable products that cannot be justified.

This regulation applies not only in Switzerland but also corresponds to European standards for distance selling of dietary supplements. You will find similar exclusions of the right of withdrawal in Germany, Austria, France, and all other European countries. This underlines that this is not an arbitrary restriction of your rights, but a necessary measure to protect public health.

Please take photos of the damage and send them with your message. We will immediately send you free replacement and clarify the cause of the damage with our shipping partner.

If you have received the wrong product or the wrong quantity, this is of course our mistake and we will correct it immediately. Contact us at support@tyrexin.ch and we will send you the correct product without you having to return the wrong delivery. Such errors are extremely rare as we have a multiple control system, but should it happen, we take full responsibility.

Should you notice a product defect, such as an unusual smell, discoloration, or damaged capsules, it is important not to consume the product and to contact us immediately. Your health comes first. We will examine the case without delay, check the affected batch, and of course send you a replacement. Additionally, we will conduct internal investigations to identify the cause and ensure that the incident does not recur.

It is important that you contact us about all problems within seven days of receiving the delivery. This allows us to react quickly and identify any problems with the affected batch before other customers could be affected.
